DECISION
Chapter 1
General Provision
Article 1.-
This proclamation aims to promote the freedom of political parties that are registered according to the law to form alliances with each other and to determine the forms and procedures for forming political party alliances in accordance with the Law on Political Parties.
Article 2.-
This proclamation applies to bilateral or multilateral political party alliances in the Kingdom of Cambodia.
Chapter 2
Principles of Political Party Alliance
Article 3.-
Political parties duly registered in accordance with the Law on Political Parties may freely form bilateral or multilateral alliances according to the decision of each political party in accordance with the statutes of political parties deposited with the Ministry of Interior. In the event that the Statutes of a Political Party do not provide for alliances, the alliance of political parties may be made by a decision of the general assembly or congress or equivalent organization of the political party.
Article 4.-
The formation of a political party alliance must have a specific agreement that states key points such as the name of the agreement, purpose, scope, composition of the political parties forming the alliance, management, work process, dispute resolution procedures, and duration of the alliance. The purpose of the alliance must not conflict with the Constitution, the Law on Political Parties, and other applicable laws.
The model form of the above agreement is an appendix to this proclamation
Article 5.-
The formation of political party alliances does not create a separate legal entity for each political party that participates in the alliance.
Chapter 3
Forms and Procedures for Forming an Alliance of Political Parties
Article 6.-
Political parties that have formed an alliance must notify the Ministry of Interior in writing within 30 (thirty) days after the date of signature by the heads of all political parties participating in the alliance, and must be attached to the agreement.
Any amendment to the agreement must be notified in writing to the Ministry of Interior within 15 (fifteen) days from the date of the amendment, and must be attached to the amended agreement.
Article 7.-
Any political party joining or withdrawing from an alliance must be notified in writing to the Ministry of Interior within 15 (fifteen) days after the announcement of joining or withdrawing from the alliance, accompanied by an agreement as specified in Article 6 of this proclamation
Article 8.-
Political parties that have formed an alliance cannot display a single joint sign with the names and symbols of the political parties in the alliance. Each political party may display a sign with the names and symbols of its own political party.
Any display of a political party sign at its headquarters or private residence or private location must have the prior consent of the owner of the residence or location. In this case, each political party member only needs to notify the commune or sangkat administration in writing about the display of the political party sign, without requiring prior permission from the local authority.
Any display of a political party sign in public places, towns or public streets must have prior permission from the local authority of the location where the sign is to be displayed.
Chapter 4
Final Provision
Article 9.-
Any provisions that are contrary to this proclamation shall be null.
Article 10.-
The Secretary General, the Director General of the General Department of Administration, the Commissioner General of the National Police, the President of the Capital and Provincial Councils, the Governors of the Capital and Provincial Governments, and the Presidents of relevant units under the Ministry of Interior shall be responsible for implementing this proclamation in accordance with their respective duties from the date of signing.
